A machine built to look legitimate

Evolution Market Group Inc. was incorporated in Panama in March 2007 and traded under the brand Finanzas Forex. The pitch was simple: your money would be professionally traded on the foreign-exchange market, with returns you could watch grow on the company website. Spain’s Audiencia Nacional later found, as proven fact, that there was no business activity capable of producing those returns.

Where the money actually went

Of roughly US$189 million received by one of its vehicles, less than 5% ever reached a real trading account — and the accounts that did trade lost money. The “profits” shown to investors were paid with deposits from newer investors: a textbook pyramid. The rest was diverted into property, companies and gold. In the United States, a civil forfeiture action documented the seizure of approximately 294 gold bars, nine vehicles and funds in multiple bank accounts.

The verdict

In 2018 the Supreme Court of Spain upheld the conviction: 13 years and 3 months in prison for the scheme’s leader and a €300 million fine, plus the dissolution of the company. By then, 186,000 people across five continents had put in more than US$390 million.

The 4 red flags everyone missed

  1. “Guaranteed” high returns. No regulated firm can guarantee profits.
  2. Rewards for recruiting. Getting paid to bring in new investors is the signature of a pyramid.
  3. Offshore entity, no licence. A Panama company with no authorisation to operate in Spain.
  4. A public regulator warning. The CNMV flagged Finanzas Forex in April 2008 — ten years before the final verdict. Checking took one minute.
